THE Apex Court will on Monday, 8th May 2023, commence hearing of the appeal of Adegboyega Oyetola, the APC candidate who lost to Senator Ademola Adeleke of the PDP in the Osun governorship election on July 16, 2022.
The Independent National Electoral Commission proclaimed Adeleke to have won the election; but, on January 27, 2023, a tribunal panel presided over by Justice Tertse Kume determined Oyetola to have won instead.
On March 24, an Appeal Court panel presided over by Justice Mohammed Shaibu overturned the decision of the governorship election tribunal to void the results of the governorship elections in July.
It was discovered that the matter has been scheduled for adoption of final written addresses by the parties on Monday as a result of an appeal by Oyetola to the Supreme Court.
One of the attorneys representing Adeleke in the case, Hasim Abioye, told The PUNCH on Sunday that the Supreme Court has listed the case for adoption of address.
He further said, “It is for adoption of briefs by the parties and it invariably means hearing of the appeal and the cross-appeal.
“The cross-appeal is on our part. We cross-appealed with the judgement of the Court of Appeal aligning the Certified True Copy. We are talking about the legitimacy of the exhibit BVR relied upon by the APC, that the date on the certified true copy, post-dated the date on the receipt.
“We are also cross-appealing on the issue of the co-authorship of the judgment, the validity of the tribunal judgement.”
Meanwhile, Voice Air Media learnt that both APC and PDP have gone spiritual over the case, seeking the face of God that the judgment be in their favour.
PDP group called its members for an online prayer session over the case beseeching God to grant them favour in the matter while APC ward leadership in the state also summoned its leadership for prayer session, for Oyetola and Tinubu’s swearing in ceremony, May 29th, 2023.
