Nigerian convicted of double murderer wins human rights case in UK — Report

A Nigerian, Obina Christopher Ezeoke, who was jailed for life for the brutal killings of a mother and her sleeping nephew in north London, has successfully argued that his human rights were breached due to the excessive length of time it took for his case to come to trial.

 

Ezeoke, 32, faced an unprecedented five trials before finally being convicted of the 2016 murders of psychology student Bervil Kalikaka-Ekofo, 21, and his aunt Annie Ekofo, 53, in their East Finchley apartment.

He was subsequently sentenced to life imprisonment with a minimum term of 40 years.

The European Court of Human Rights has now ruled that the five-year court process leading to Ezeoke’s conviction constituted a breach of Article 6 of the European Convention on Human Rights, which guarantees a fair public hearing within a “reasonable time.”

The Telegraph report on Monday indicated the delays in the case were attributed to a series of unfortunate events. The first trial collapsed due to the presiding judge falling ill, the second and third ended with hung juries, and the fourth was halted by the onset of the COVID-19 pandemic.

Despite acknowledging that these delays were largely outside the control of the courts or the government, the Strasbourg-based court still concluded that the length of the proceedings was a violation of Ezeoke’s rights.

However, in a significant aspect of the ruling, the ECHR rejected Ezeoke’s plea for immediate release from his life sentence.

The court stated that despite the considerable delay, his eventual conviction and sentence were not deemed unfair and, therefore, did not constitute a further breach of Article 6 in those respects. Furthermore, the court ruled that Ezeoke was not entitled to any compensation.

The shadow justice secretary, Robert Jenrick, strongly criticized the ruling, stating: “This is the latest extraordinary example of judicial activism by the Strasbourg court. It only seems to get worse.”

The details of the horrific crime revealed that Ezeoke executed Bervil Kalikaka-Ekofo, who was shot in the back of the head with a vintage Western-style revolver while sleeping.

He then shot Annie Ekofo in the chest with a Smith and Wesson .44 as she emerged from her bedroom. The Old Bailey heard that the murders were a revenge attack targeting Ms. Ekofo’s son, Ryan Efey, 22, after rivals shared footage of Ezeoke being attacked on Snapchat. Ezeoke reportedly decided to kill anyone present in the flat.

Sentencing Ezeoke in 2020, Mrs Justice Cutts described the murders as “cold, callous and brutal,” stating that he had not only cut short the lives of two innocent people but had also “ruined the lives of many.”

She explained that while she had considered a whole-life order, she ultimately opted for a life sentence with a 40-year minimum term.

During the legal proceedings, Ezeoke’s defence argued against a fifth trial, claiming that the repeated delays had significantly weakened their evidence, making the outcome of the final trial potentially unsafe.

Ezeoke himself argued to the European court that the extended legal process had a detrimental effect on the quality of his defence.

The ECHR specifically identified two periods of delay as “problematic”: the year-long gap between the third and fourth trials, and the six-month period before his application for permission to appeal was rejected.

Despite the finding of a human rights violation due to the length of the proceedings, Obina Christopher Ezeoke remains incarcerated in a high-security prison, serving his life sentence for the brutal double murders.

The ruling highlights the delicate balance between ensuring a fair trial within a reasonable timeframe and holding individuals accountable for serious crimes.
