A Federal High Court presiding over the controversial case of the reappointment of Mallam Muhammadu Sanusi II as the 16th Emir of Kano has nullified the appointment and any other actions taken after it.
The presiding Judge, Justice Abdullahi Muhammad Liman said, ” I hereby order that every step taking by the Kano State Government are here by nullified and becomes null and invalid and that this does not affect the validity of the Emirates repealed law but actions taken by the Governor which includes the assenting to the law and the reappointment”.
Delivering his ruling on the matter on Thursday, Justice Liam said, “I have listened to the audio of Governor Audio both in Hausa and English after assenting to the law, and becomes convinced that the respondents are aware of the order of maintaining statisquo pending the hearing and determination of the motions on notice in the Court.”
He said that having been satisfied that the defendants becomes aware of the court order, the court in it’s powers set aside an action because is in violation of the court order, I think is a very serious matter for anyone to flaunt the powers of the court and scort free with it”.
He said this catastrophy could have been saved if the defendants followed due processes, by compliance of the court order would have still allowed them to carried out their assignments.
But he worried that they however they decided to used their whims and caprices and have landed them into this serious mess.
Justice Liman said the Law still remains, but have an order seeking to quashed the new Law which he continue hearing on the matter.
