‘YES OR NO’ Ballot Paper: Here’s What The Law Says

As the election conducted by Osun State Independent Electoral Commission (OSIEC) yesterday, October 15, 2022, created alot of controversies from different individuals as a result of the ‘YES OR NO’ votes system which replaced names, logo’s of political parties on the ballot paper surfaced.

Speaking to Voice Air Media at Ilobu, Irepodun local government, Barr. Adegoke Ogunsola, the legal adviser to the ruling All Progressives Congress (APC) said, he was surprised that people are making noise where we are not suppose to have any noise.

According to him, It’s cleared by the provision of law that where a candidate contest an election and that particular position is an executive position and not a legislative position, you must organize ‘YES Or NO’ votes for that particular position, because you cannot put one political party on ballot paper, what the law says is that you use YES or NO. so if you have the required ‘YES’ then you declare the person a winner.

This newspaper, quoting from the Official Gazette Electoral Act, 2022 & INEC Independent National Electoral Commission 2023 Election Guildelines And Schedule; Section 106. (1) A candidate for an election to the office of the Chairman shall be deemed to have been duly elected to the office where being the only candidate nominated for the election he or she has —

(a) a majority of YES vote Over NO votes cast at the election; and

(b) not less than one-third of the votes cast at the election in each of at least two-thirds of all the wards in the Area Council.

“We should not forget that the Chairman Osun State Independent Electoral Commission (OSIEC) is a lawyer of over 40years, he could not make any mistake in that respect, it’s clearly written in the law that in a position where there’s only one candidate contesting an election, you should not put the logo of that political party.

Barrister Adegoke Ogunsola, appreciated the Vice Chairman, the 10 Councilors of irepodun local government who have just been elected, including the people of irepodun for their perseverance, and pledged to serve wholeheartedly.

According to him, “We would do our best, We met some parts of Ilobu in darkness, we were able to restore electricity by purchasing a new transformer, our local government is one of the local governments that suffered #EndSars# attack to the extent that the roof of our local government secretariat were seriously damaged, when we came, there was no conducive atmosphere to operate, we had to construct new roof, in addition to that, we gave financial support to some individuals and organisations, prominently Ilobu National Student Union, we released a sum of 1millon naira to them because we believe in youth.
